Terms of Use
Last updated: 14 October 2026
Welcome to Nirana.
These Terms of Use, together with our Privacy Policy, form the agreement (Terms) between Jivaha Pty Ltd ACN 701 587 546 (we, us or our) and anyone who downloads, opens, subscribes to or uses the App (you). These Terms also operate as the end user licence agreement for the App.
Please read these Terms carefully before using the App. By creating an account or using the App, you agree to be bound by these Terms. A link to these Terms is provided to you before your account is created.
IMPORTANT — Nirana is a relaxation and reflection tool. It is not a medical device and does not provide diagnosis, therapy or treatment. Nothing in the App is medical, psychological or other professional advice, and the App is not a substitute for care from a qualified professional. If you are in crisis or need urgent help, contact your local emergency services.
1. Definitions
In these Terms:
- App means the Nirana mobile application, including all sessions, activities, games, audio, text, images and other content we make available through it, and any updates to it.
- App Store means the Apple App Store, Google Play, or any other digital storefront through which we distribute the App.
- Applicable Law means all laws, rules, regulations, codes, orders and statutes applicable in Australia, including the Privacy Act 1988 (Cth) and the Australian Consumer Law.
- Content means all material we make available in or through the App.
- Intellectual Property Rights means all intellectual property rights, including copyright, trade marks, patents, domain names, trade secrets and know-how, recognised under Australian law and international conventions.
- Personal Information has the meaning given in section 6 of the Privacy Act 1988 (Cth).
- Subscription means a paid, automatically renewing subscription to the App purchased through an App Store.
- Website means https://nirana.app, together with any subdomains and related pages we operate.
2. Acceptance of these Terms
- By creating an account or using the App, you confirm that you have read, understood and agree to these Terms.
- If you do not agree with these Terms, you must not use the App.
3. Who can use the App
You confirm that:
- you are at least 16 years of age;
- you have the legal capacity to enter into these Terms; and
- you will comply with all Applicable Law when using the App.
4. Health and wellbeing
- The App is provided for relaxation, reflection and general wellbeing. It is not designed, and must not be used, as a treatment for anxiety, depression or any other health condition.
- Nothing in the App constitutes medical, psychological, or other professional advice, diagnosis or treatment, and no clinical outcome is promised or implied.
- You should not disregard, delay or discontinue professional advice or treatment because of anything in the App.
- If you are experiencing a medical or mental health emergency, or you are concerned about your safety or the safety of another person, contact your local emergency services immediately.
5. Licence
- We grant you a limited, non-exclusive, non-transferable, non-sublicensable, revocable licence to install and use the App on a device that you own or control, for your own personal and non-commercial use, in accordance with these Terms and any applicable App Store rules.
- You may share images you create in the App, such as Create & Flow artwork or a Night Lights postcard, for your own personal and non-commercial purposes, including on social media and in messages to friends and family.
- All rights not expressly granted to you are reserved by us.
6. Your account
- Some features require you to create an account. You must provide accurate information and keep it up to date.
- You are responsible for keeping your account credentials confidential and for activity that occurs under your account.
- You must tell us promptly if you believe your account has been accessed without your authorisation.
- You may choose to use a Subscription without creating an account. If you do, your Subscription is linked to your App Store account, your progress is kept only on that device, and it cannot be recovered if the App is deleted or the device is lost. You can create an account later in the App, and your Subscription and progress will move into it.
7. Subscriptions, trials and payment
7.1 Purchases are made through the App Store
- Subscriptions are sold and processed by the App Store, not by us. Your payment relationship for a Subscription is with Apple or Google, and their terms also apply to the transaction.
- The price shown in the App is provided by the App Store in your local currency and includes any applicable taxes, unless stated otherwise by the App Store.
7.2 Automatic renewal
- A Subscription renews automatically at the end of each billing period, at the then-current price, until it is cancelled.
- Payment is charged to your App Store account when you confirm the purchase, or when a free trial ends.
- Your Subscription renews automatically unless it is cancelled at least 24 hours before the end of the current period. Your App Store account will be charged for renewal within the 24 hours before the end of the current period.
- You can view, change and cancel your Subscription in your App Store account settings at any time. The App also links there from Settings → Manage plan.
- If you reinstall the App or move to a new device, you can restore an existing Subscription with the Restore option on the subscription screen, or by signing in to your account.
7.3 Free trials
- Where we offer a free trial, the length and conditions of the trial are shown before you subscribe.
- Unless you cancel at least 24 hours before the trial ends, the Subscription will begin and the first payment will be taken automatically.
- Free trials are available once per person. Eligibility is decided by the App Store, which may not offer a trial if you, your App Store account or your payment method has had one before. If you are not eligible, the App Store will tell you before you confirm the purchase.
- If you cancel during a free trial, you keep access until the trial ends.
7.4 Cancellation
- You may cancel at any time through your App Store account settings.
- Cancellation takes effect at the end of the current billing period. You keep access until then.
- Uninstalling the App does not cancel a Subscription.
7.5 Refunds
- Because purchases are processed by the App Store, refunds are handled under the policies of Apple or Google, and requests must be made to them.
- Except where required by law, fees are not refundable for partially used billing periods.
- Nothing in this clause limits your rights under the Australian Consumer Law.
8. Changes to the App
- We may add, change, suspend or remove features of the App to improve it, or for security, legal or operational reasons.
- Where a change would materially reduce the core functionality of a paid Subscription, we will take reasonable steps to notify you in advance where practicable.
9. Availability
- We aim to keep the App available, but uninterrupted access is not guaranteed. The App may be affected by maintenance, device or network issues, or problems with third-party services we rely on.
- We are not responsible for interruptions, delays or failures caused by events or services outside our reasonable control.
- Parts of the App need an internet connection. You are responsible for your own device, data and connectivity costs.
10. Acceptable use
You must not:
- copy, modify, distribute, sell, licence, publicly perform or create derivative works from the App or its Content, except as permitted by these Terms or by law;
- reverse engineer, decompile or attempt to extract the source code of the App, except to the extent this restriction is prohibited by law;
- circumvent, disable or interfere with any security, licensing or access control feature, including any measure that limits access to paid features;
- use the App to break the law, infringe another person’s rights, or transmit anything unlawful or malicious; or
- use automated means to access, scrape or place unreasonable load on the App or our systems.
11. Intellectual property
11.1 Our rights
- We (and our licensors) retain all right, title and interest in and to the App and all related Intellectual Property Rights, including all software, audio, text, images, designs, names and logos.
- Nothing in these Terms transfers any Intellectual Property Rights to you.
11.2 Your material
- The App lets you assemble a vision board from stock photography and your own selections. Boards you create are stored on your device.
- You are responsible for ensuring you have the rights to use any image you add to the App from your own device, and you must comply with the licence terms of any stock photography provider whose images you use.
12. Third-party services and content
- The App relies on third-party services, including authentication, hosting, subscription management and stock photography providers, and on the App Stores.
- Those services operate under their own terms and privacy policies. We do not control them and are not responsible for their availability, performance or independent data handling.
- Stock photography shown in the App is provided by third parties and remains subject to their licence terms.
13. Privacy
- We handle Personal Information in accordance with the Privacy Act 1988 (Cth) and our Privacy Policy, which forms part of these Terms.
- You acknowledge that Personal Information may be stored or processed outside Australia, as described in our Privacy Policy.
14. Warranties and disclaimers
- To the maximum extent permitted by law, and subject to clause 16, the App and its Content are provided on an “as is” and “as available” basis, and we make no warranties or representations, express or implied, including as to accuracy, reliability, completeness, fitness for a particular purpose, non-infringement or uninterrupted availability.
- We do not warrant that the App will achieve any particular outcome for you, including any change in how you feel, sleep or function.
- We are not responsible for the availability, performance or reliability of third-party services the App relies on.
15. Limitation of liability
- To the extent permitted by law, and subject to clause 16, our total aggregate liability to you under or in connection with these Terms is limited to the total fees you paid us (or paid through an App Store for the App) in the twelve (12) month period immediately before the event giving rise to the claim, or fifty Australian dollars (A$50) if you have paid nothing.
- This limitation applies however the liability arises, including breach of contract, tort (including negligence), misrepresentation, under an indemnity or warranty, by operation of law, or otherwise.
- To the maximum extent permitted by law, we are not liable for any indirect, incidental, special or consequential loss, including loss of profits, revenue, goodwill, opportunity or data, even if we have been advised of the possibility of such loss.
16. Australian Consumer Law
- Our goods and services come with guarantees that cannot be excluded under the Australian Consumer Law.
- Nothing in these Terms excludes, restricts or modifies any consumer guarantee, right or remedy that cannot be excluded under the Australian Consumer Law.
- Where liability cannot be excluded but can be limited, our liability is limited, at our option, to supplying the services again or paying the cost of having them supplied again.
17. Indemnity
You agree to indemnify us (including our officers, employees, contractors and licensors) against any loss, damage, liability, cost or expense (including reasonable legal costs) arising from your breach of these Terms, your misuse of the App, or your infringement of another person’s rights. This does not apply to the extent the loss is caused by our negligence, fraud or wilful misconduct, or to any liability that cannot be excluded by law.
18. Suspension and termination
- You may stop using the App at any time. You can delete your account in the App under Me → Settings → Delete my account, on our Website at nirana.app/delete-account.html, or by contacting us. Deleting your account does not cancel a Subscription; please cancel it in your App Store account settings.
- We may suspend or terminate your access to the App immediately if you materially breach these Terms, if we are required to do so by law, or if suspension is reasonably necessary to protect the security or integrity of the App.
- Where practicable, we will give you notice and an opportunity to remedy the breach.
- On termination, your licence ends and you must stop using the App. Any accrued payment obligations remain payable, and clauses that by their nature should survive termination (including intellectual property, disclaimers, limitation of liability, privacy and governing law) survive.
19. Changes to these Terms
- We may change these Terms from time to time. If a change is material, we will make reasonable efforts to give you at least 30 days’ notice before it takes effect. Whether a change is material will be determined acting reasonably.
- If you do not agree to a material change, you may cancel your Subscription before the change takes effect and stop using the App.
20. Governing law
- These Terms are governed by the laws of New South Wales, Australia.
- You and we submit to the non-exclusive jurisdiction of the courts of New South Wales, Australia.
21. General
- Severance: if a court decides any part of these Terms cannot be enforced, that part is removed and the rest continues to apply.
- Entire agreement: these Terms, together with our Privacy Policy, set out the whole agreement between you and us about the App.
- No waiver: if we do not enforce a right immediately, that is not a waiver of that right.
22. Additional terms for the Apple App Store
The following apply where you obtained the App from the Apple App Store, and prevail over the rest of these Terms to the extent of any inconsistency:
- These Terms are between you and Jivaha Pty Ltd only, and not with Apple Inc. (Apple). Apple is not a party to these Terms and is not responsible for the App or its content.
- The licence granted in clause 5 is limited to a non-transferable licence to use the App on any Apple-branded product that you own or control, as permitted by the Usage Rules in the Apple Media Services Terms and Conditions.
- We, and not Apple, are solely responsible for providing any maintenance and support services for the App. Apple has no obligation to furnish maintenance or support.
- To the maximum extent permitted by law, Apple has no warranty obligation with respect to the App. If the App fails to conform to any applicable warranty, you may notify Apple and Apple will refund the purchase price (if any) for the App; to the maximum extent permitted by law Apple has no other warranty obligation, and any other claims, losses, liabilities, damages, costs or expenses attributable to a failure to conform to a warranty are our responsibility.
- We, and not Apple, are responsible for addressing any claim by you or a third party relating to the App or your possession or use of it, including product liability claims, any claim that the App fails to conform to a legal or regulatory requirement, and claims arising under consumer protection or similar legislation.
- We, and not Apple, are responsible for the investigation, defence, settlement and discharge of any third-party claim that the App or your use of it infringes that third party’s intellectual property rights.
- You represent and warrant that you are not located in a country subject to a United States Government embargo or designated as a “terrorist supporting” country, and that you are not listed on any United States Government list of prohibited or restricted parties.
- You must comply with any applicable third-party terms of agreement when using the App.
- Apple and its subsidiaries are third-party beneficiaries of these Terms and, upon your acceptance, have the right (and are deemed to have accepted the right) to enforce these Terms against you as a third-party beneficiary.
- Our contact details for any questions, complaints or claims about the App are set out in clause 24.
23. Additional terms for Google Play
- Where you obtained the App from Google Play, these Terms are between you and Jivaha Pty Ltd only, and not with Google LLC.
- Your use of the App is also subject to the Google Play Terms of Service, and Google is not responsible for the App or its content.
